1. Without prejudice to Article 77, an application for the grant of a residence permit on the basis of the provisions of this section is refused if:

b) The documents submitted were obtained fraudulently or have been falsified or tampered with;
b) Os documentos apresentados tiverem sido obtidos de modo fraudulento, falsificados ou adulterados;
c) The host entity was established or operates for the main purpose of facilitating the entry of third-country nationals, or has been sanctioned, in accordance with national law, for undeclared work and/or illegal employment; or
c) A entidade de acolhimento tiver sido estabelecida ou funcione com o principal propósito de facilitar a entrada de nacionais de Estado terceiro, ou se tiver sido sancionada, em conformidade com a legislação nacional, por trabalho não declarado e/ou emprego ilegal; ou
d) The host entity has failed to comply with its legal obligations regarding social security, taxation, labour rights or working conditions, or is being or has been wound up or declared insolvent under national law, or has no economic activity.
d) A entidade de acolhimento não tiver respeitado as obrigações legais em matéria de segurança social, fiscalidade, direitos laborais ou condições de trabalho ou estiver a ser ou tenha sido dissolvida ou declarada insolvente, nos termos da legislação nacional, ou não registar qualquer atividade económica.
2. Without prejudice to Article 78, an application for renewal of a residence permit on the basis of the provisions of this section is refused if, as the case may be:
2 - Sem prejuízo do disposto no artigo 78.º, o pedido de renovação de autorização de residência com base nas disposições da presente secção é indeferido se, consoante os casos:
b) The applicant is residing in national territory for reasons other than those for which residence was authorised;
b) O requerente residir em território nacional por razões diferentes daquelas pelas quais a residência foi autorizada;
c) The applicant is carrying out a professional activity in breach of Article 97;
c) O requerente exercer atividade profissional em violação do disposto no artigo 97.º;
d) The applicant is not making satisfactory progress in their studies;
d) O requerente não progredir nos estudos com aproveitamento;
e) The documents submitted were obtained fraudulently or have been falsified or tampered with;
e) Os documentos apresentados tiverem sido obtidos de modo fraudulento, falsificados ou adulterados;
f) One of the situations referred to in points (c) and (d) of the preceding paragraph occurs.
f) Se verificar a ocorrência de uma das situações previstas nas alíneas c) e d) do número anterior.
3. Without prejudice to Article 85(1), the residence permit is cancelled if any of the situations referred to in the preceding paragraph arises.
3 - Sem prejuízo do n.º 1 do artigo 85.º, a autorização de residência é cancelada se se verificarem as situações do número anterior.
4. Decisions refusing the grant or renewal of a permit, and decisions on cancellation, take into account the specific circumstances of the case and respect the principle of proportionality.
4 - A decisão de indeferimento de concessão ou de renovação, bem como de cancelamento, tem em consideração as circunstâncias específicas do caso e respeitam o princípio da proporcionalidade.
5. Whenever a researcher or higher education student is residing in the territory of another Member State under the mobility provisions and the Agency for Integration, Migration and Asylum (AIMA) becomes aware of the situation, it notifies the authorities of that Member State of the cancellation of the residence permit under paragraph 3.
5 - Sempre que o investigador ou estudante do ensino superior se encontre a residir no território de outro Estado membro ao abrigo das disposições de mobilidade e a AIMA, I. P., tiver conhecimento da situação, notifica as autoridades desse Estado membro do cancelamento da autorização de residência ao abrigo do n.º 3.
