1. An EU Blue Card for the purpose of pursuing a highly qualified activity is granted to a third-country national who, in addition to the conditions laid down in points (a) to (d) and (f) to (j) of Article 77(1) and in Article 77(2), cumulatively meets the following requirements:
1 - É concedido 'cartão azul UE' para efeitos de exercício de atividade altamente qualificada ao cidadão nacional de Estado terceiro que, para além das condições previstas nas alíneas a) a d) e f) a j) do n.º 1 e n.º 2 do artigo 77.º, preencha, cumulativamente, os seguintes requisitos:
a) Presents an employment contract or a promise of an employment contract compatible with the pursuit of a highly qualified activity, with a duration of not less than six months and an annual salary of at least 1.5 times the national average gross annual salary or, in the cases provided for in Article 61-A(2), of at least 1.2 times the national average gross annual salary;
a) Apresente contrato de trabalho ou contrato promessa de trabalho compatível com o exercício de uma atividade altamente qualificada e de duração não inferior a seis meses, a que corresponda uma remuneração anual de pelo menos 1,5 vezes o salário anual bruto médio nacional ou, nos casos previstos no n.º 2 do artigo 61.º-A, de pelo menos 1,2 vezes o salário anual bruto médio nacional;
b) Has health insurance or presents proof of being covered by the National Health Service;
b) Disponha de seguro de saúde ou apresente comprovativo de que se encontra abrangido pelo Serviço Nacional de Saúde;
c) Is registered with social security, where applicable;
c) Esteja inscrito na segurança social, quando aplicável;
d) In the case of an unregulated profession, presents a document proving higher professional qualifications in the activity or sector specified in the employment contract or in the promise of an employment contract;
d) No caso de profissão não regulamentada, apresente documento comprovativo de qualificações profissionais elevadas na atividade ou setor especificado no contrato de trabalho ou no contrato promessa de contrato de trabalho;
e) In the case of a regulated profession indicated in the employment contract or in the promise of an employment contract, presents a document proving professional certification, where applicable;
e) No caso de profissão regulamentada indicada no contrato de trabalho ou no contrato promessa de contrato de trabalho, apresente documento comprovativo de certificação profissional, quando aplicável;
g) All conditions under national law laid down in collective agreements or arising from the practices of the relevant professional sectors for highly qualified employment are met.
g) Se encontrem cumpridas todas as condições decorrentes do direito nacional previstas em convenções coletivas ou decorrentes das práticas dos setores profissionais relevantes, para efeitos de emprego altamente qualificado.
2. The applicant may be exempted from the requirement referred to in Article 77(1)(a) whenever they hold a valid right of residence in national territory.
2 - O requerente pode ser dispensado do requisito a que se refere a alínea a) do n.º 1 do artigo 77.º sempre que seja titular de direito de residência válido em território nacional.
3. An applicant who holds a residence permit for the purpose of highly qualified activity granted under Article 90 is exempted from proving the requirements laid down in paragraph 1(d) and (e), if these have already been verified, and the requirement laid down in paragraph 1(b), except where there is a change of employer.
3 - O requerente que seja titular de uma autorização de residência para efeitos de atividade altamente qualificada concedida ao abrigo do artigo 90.º é dispensado de comprovar os requisitos previstos nas alíneas d) e e) do n.º 1, se já tiverem sido verificados, e o requisito previsto na alínea b) do n.º 1, salvo na situação em que ocorra alteração do empregador.
4. For the purposes of paragraph 1(d), Article 61-A(3) applies.
4 - Para efeitos da alínea d) do n.º 1 é aplicável o disposto no n.º 3 do artigo 61.º-A.
5. Having weighed the principle of proportionality and the specific circumstances of the individual case, the application for the grant of an EU Blue Card is refused where:
5 - Ponderados o princípio da proporcionalidade e as circunstâncias específicas do caso concreto, o pedido de concessão de 'cartão azul UE' é indeferido quando:
a) Any of the requirements laid down in paragraph 1 is not met;
a) Não se verifique o cumprimento de quaisquer dos requisitos previstos no n.º 1;
b) The documents presented have been obtained fraudulently, or have been falsified or altered;
b) Os documentos apresentados tenham sido obtidos de forma fraudulenta, ou tenham sido falsificados ou alterados;
c) The third-country national concerned is considered a threat to public policy, public security or public health;
c) O nacional do Estado terceiro em causa for considerado uma ameaça para a ordem pública, a segurança pública ou a saúde pública;
d) The employer was established or operates for the main purpose of facilitating the entry of third-country nationals, is not carrying on any professional activity, or has been sanctioned in the last five years for making use of illegal work by foreign workers.
d) O empregador estiver estabelecido ou operar com o objetivo principal de facilitar a entrada de nacionais de Estados terceiros, não esteja a desenvolver qualquer atividade profissional ou tiver sido sancionado por utilização de atividade ilegal de trabalhadores estrangeiros nos últimos cinco anos.
