1. In addition to the general requirements laid down in Article 77, a residence permit for the exercise of a self-employed professional activity shall be granted only to third-country nationals who meet the following requirements:
1 - Para além dos requisitos gerais estabelecidos no artigo 77.º, só é concedida autorização de residência para exercício de actividade profissional independente a nacionais de Estados terceiros que preencham os seguintes requisitos:
a) They have set up a company in accordance with the law, declared the commencement of activity as a natural person to the tax administration and to social security, or entered into a contract for the provision of services for the exercise of a liberal profession;
a) Tenham constituído sociedade nos termos da lei, declarado o início de actividade junto da administração fiscal e da segurança social como pessoa singular ou celebrado um contrato de prestação de serviços para o exercício de uma profissão liberal;
b) They are qualified to engage in a self-employed professional activity, where applicable;
b) Estejam habilitados a exercer uma actividade profissional independente, quando aplicável;
c) They have means of subsistence, as defined by the order (portaria) referred to in Article 52(1)(d);
c) Disponham de meios de subsistência, tal como definidos pela portaria a que se refere a alínea d) do n.º 1 do artigo 52.º;
e) Where required, they submit a declaration from the relevant professional association (ordem) stating that they meet its registration requirements.
e) Quando exigível, apresentem declaração da ordem profissional respectiva de que preenchem os respectivos requisitos de inscrição.
3. The holder of a residence permit for the exercise of a self-employed professional activity may engage in an employed professional activity, in which case the preceding Article applies, with the necessary adaptations, subject to replacement of the residence card.
3 - O titular de uma autorização de residência para exercício de uma actividade profissional independente pode exercer uma actividade profissional subordinada, sendo aplicável, com as necessárias adaptações, o disposto no artigo anterior, mediante substituição do título de residência.
4. A residence permit shall be granted to a third-country national who is developing an entrepreneurial project, including the creation of an innovation-based company, within a certified incubator as defined by order (portaria) of the members of the Government responsible for migration, internal administration and the economy, provided that they meet the general requirements of Article 77, the requirement in paragraph 1(a) of that Article being waived.
4 - É concedida autorização de residência ao nacional de Estado terceiro que desenvolva projeto empreendedor, incluindo a criação de empresa de base inovadora, integrado em incubadora certificada nos termos definidos por portaria dos membros do Governo responsáveis pelas áreas das migrações, administração interna e da economia, desde que preencha os requisitos gerais do artigo 77.º, com dispensa do estabelecido na alínea a) do seu n.º 1.
6. The holder of a residence permit for the exercise of a self-employed professional activity may change the nature of the activity by notifying the Agency for Integration, Migration and Asylum (AIMA), without a new residence card having to be issued.
6 - O titular de autorização de residência para exercício de atividade profissional independente pode alterar a natureza da atividade mediante comunicação à AIMA, IP, sem necessidade de emissão de novo título.
