1. Within the scope of this Chapter, court actions concerning decisions or omissions of the Agency for Integration, Migration and Asylum (AIMA) take the form of an administrative action under Article 37 of the Code of Procedure in the Administrative Courts, without prejudice to recourse to interim relief under the general rules.
1 - No âmbito do presente capítulo, as ações judiciais relativas às decisões ou omissões da AIMA, IP, revestem a forma de ação administrativa, nos termos do artigo 37.º do Código de Processo nos Tribunais Administrativos, sem prejuízo do recurso à tutela cautelar, nos termos gerais.
2. Recourse to a summons for the protection of rights, freedoms and guarantees (intimação para a proteção de direitos, liberdades e garantias) is admissible where, in addition to the requirements referred to in Article 109(1) of the Code of Procedure in the Administrative Courts, the action or omission of AIMA compromises, in a demonstrably serious and direct manner, the timely exercise of personal rights, freedoms and guarantees whose protection cannot be effectively ensured through the available interim measures.
2 - O recurso à intimação para a proteção de direitos, liberdades e garantias é admissível quando, para além dos pressupostos referidos no n.º 1 do artigo 109.º do Código de Processo nos Tribunais Administrativos, a atuação ou omissão da AIMA, IP, comprometa, de modo comprovadamente grave e direto, o exercício, em tempo útil, de direitos, liberdades e garantias pessoais, cuja tutela não possa ser eficazmente assegurada através dos meios cautelares disponíveis.
3. In the decision to be taken in summons proceedings where AIMA has failed to act in good time, the judge must, if so requested, weigh the number of administrative procedures pending before that entity in view of any abnormal pressure of applications and requests, and the human, administrative and financial resources available that may reasonably be expected, and must also take into account the consequences that the summons may have for the equitable handling of all applications addressed to AIMA.
3 - Na decisão a adotar no processo de intimação, em caso de ausência atempada de atuação da AIMA, IP, o juiz deve ponderar, se requerido, o número de procedimentos administrativos que correm junto daquela entidade, em face de eventuais pressões anormais de pedidos e solicitações, os meios humanos, administrativos e financeiros disponíveis, que é razoável esperar, bem como ter em conta as consequências que possam resultar da intimação para o tratamento equitativo de todos os requerimentos dirigidos à AIMA, IP.
4. In the situations provided for in paragraph 2, Articles 109 to 111 of the Code of Procedure in the Administrative Courts apply, with the adaptations required by this Article.
4 - Nas situações previstas no n.º 2, tem lugar a aplicação dos artigos 109.º a 111.º do Código de Processo nos Tribunais Administrativos, com as devidas adaptações impostas pelo presente artigo.
