1. Without prejudice to the rights conferred by Article 83, EU Blue Card holders enjoy equal treatment with nationals as regards:
1 - Sem prejuízo dos direitos conferidos pelo artigo 83.º, os titulares de 'cartão azul UE' beneficiam de tratamento igual ao dos nacionais, no que diz respeito:
a) Conditions of employment, in particular the minimum working age, and working conditions, including those relating to pay, dismissal, working hours, leave and holidays, as well as health and safety requirements at work;
a) Às condições de emprego, nomeadamente à idade mínima para trabalhar, e às condições de trabalho, incluindo as relativas à remuneração, despedimento, horários de trabalho, licenças e férias, bem como aos requisitos de saúde e segurança no trabalho;
b) Freedom of association and affiliation with and membership of an organisation representing workers or employers, or of any organisation whose members are engaged in a specific occupation, including the benefits conferred by such organisations, without prejudice to national provisions on public policy and public security;
b) À liberdade de associação, filiação e adesão a uma organização representativa de trabalhadores ou empregadores, ou a qualquer organização cujos membros se dediquem a determinada ocupação, incluindo as vantagens proporcionadas por esse tipo de organizações, sem prejuízo das disposições nacionais em matéria de ordem e segurança pública;
c) Education and vocational training, subject to the requirements laid down in the applicable legislation;
c) Ao ensino e à formação profissional, nos termos dos requisitos definidos na legislação aplicável;
d) Recognition of diplomas, certificates and other professional qualifications, in accordance with the applicable legislation;
d) Ao reconhecimento de diplomas, certificados e outras qualificações profissionais, em conformidade com a legislação aplicável;
e) The applicable provisions on social security;
e) Às disposições aplicáveis relativas à segurança social;
f) Payment of statutory old-age pension rights acquired on the basis of income and at the applicable rate;
f) Ao pagamento dos direitos à pensão legal por velhice, adquiridos com base nos rendimentos e à taxa aplicável;
g) Access to goods and services and the supply of goods and services made available to the public, including procedures for obtaining housing, as well as the information and advice provided by employment services;
g) Ao acesso a bens e serviços e ao fornecimento de bens e serviços ao público, incluindo as formalidades de obtenção de alojamento, bem como a informação e o aconselhamento prestados pelos serviços de emprego;
2. The right to equal treatment, as laid down in paragraph 1, is without prejudice to the right to cancel or refuse the EU Blue Card under Article 121-F.
2 - O direito à igualdade de tratamento, conforme estabelecido no n.º 1, não prejudica o direito de cancelar ou indeferir o 'cartão azul UE', nos termos do artigo 121.º-F.
3. Equal treatment in the situations provided for in paragraph 1, with the exception of points (b) and (d), may be limited where the holder of an EU Blue Card from another Member State moves to national territory under Article 121-K and a positive decision on the grant of an EU Blue Card in Portugal has not yet been taken.
3 - Pode ser limitada a igualdade de tratamento nas situações previstas no n.º 1, com exceção das alíneas b) e d), quando o titular de um 'cartão azul UE' de outro Estado membro se deslocar para o território nacional, nos termos do artigo 121.º-K, e ainda não tenha sido tomada uma decisão positiva quanto à concessão do 'cartão azul UE' em Portugal.
4. Where the decision referred to in the previous paragraph has not yet been adopted and the applicant is authorised to work, equal treatment is full.
4 - Nos casos em que a decisão a que se refere o número anterior não foi ainda adotada e o candidato seja autorizado a trabalhar, a igualdade de tratamento é plena.
5. The equal treatment provided for in this provision applies only to EU Blue Card holders who are beneficiaries of international protection granted by another Member State.
5 - A igualdade de tratamento prevista na presente norma só se aplica aos titulares de 'cartão azul UE' que sejam beneficiários de proteção internacional concedida por outro Estado-Membro.
6. The equal treatment provided for in paragraph 1 applies to third-country nationals and their family members who have exercised the right to long-term mobility under Article 121-M.
6 - A igualdade de tratamento prevista no n.º 1 aplica-se aos nacionais de país terceiro e seus familiares que tenham exercido o direito de mobilidade de longo prazo ao abrigo do artigo 121.º-M.
7. The equal treatment provided for in paragraph 1 does not apply to family members of an EU Blue Card holder who are beneficiaries of the right of free movement under Union law.
7 - A igualdade de tratamento prevista no n.º 1 não se aplica aos membros da família do titular de 'cartão azul UE' que sejam beneficiários do direito de livre circulação ao abrigo do direito da União.
