1. An application for a residence permit may be made by the person concerned, by their legal representative or by the employer, and must be submitted to the Agency for Integration, Migration and Asylum (AIMA), without prejudice to the special regimes laid down in the instruments referred to in Article 5(1).

b) O requerente tenha sido condenado em Portugal por sentença com trânsito em julgado em pena de prisão superior a 1 ano, ainda que esta não tenha sido cumprida, ou tenha sofrido mais de uma condenação em idêntica pena, ainda que a sua execução tenha sido suspensa; ou
c) The information from the Borders and Foreigners Coordination Unit (UCFE) referred to in Article 82(2)(b) concludes that there are reasons of internal security, public policy or prevention of illegal immigration and related crime that preclude the grant or renewal of a residence permit.

4. While the application for a residence permit is pending for reasons not attributable to the applicant, the holder of the residence visa may engage in a professional activity in accordance with the law.
4 - Na pendência do pedido de autorização de residência, por causa não imputável ao requerente, o titular do visto de residência pode exercer uma atividade profissional nos termos da lei.
5. An applicant for a residence permit may apply for family reunification at the same time.
