1. The residence permit for intra-corporate transferees entitles its holder to reside and work in national territory in the context of a transfer within an undertaking or group of undertakings (TDE or intra-corporate transfer – ICT).

2. This subsection does not apply to third-country nationals who:

a) Have applied for or hold a residence permit for research under Article 91-B;
a) Tenha requerido ou seja titular de autorização de residência para investigação, nos termos do artigo 91.º-B;
b) Enjoy rights of movement equivalent to those of EU citizens under agreements concluded between the European Union and its Member States and the third country of which they are nationals or in whose territory the undertaking for which they work is established;
b) Beneficie de direitos de circulação equivalentes aos dos cidadãos da União Europeia, por força de acordos celebrados entre a União Europeia e os seus Estados membros com o Estado terceiro de que é nacional ou em cujo território esteja estabelecida a empresa na qual trabalha;
c) Are posted under Directive 96/71/EC of the European Parliament and of the Council of 16 December 1996;
c) Seja destacado ao abrigo da Diretiva (CE) 96/71/CE, do Parlamento Europeu e do Conselho, de 16 de dezembro de 1996;
e) Are party to a contract concluded with temporary employment agencies or any other agencies that make persons available to carry out a professional activity under the supervision and direction of another person;
e) Seja outorgante de contrato celebrado com agências de emprego de trabalho temporário ou quaisquer outras que disponibilizem pessoas para exercer atividade profissional sob a supervisão e direção de outrem;
f) Hold a residence permit for the purposes of study or of a short-term traineeship forming part of a curriculum.
f) Seja titular de autorização de residência para efeitos de estudo ou estágio de curta duração integrado em programas curriculares.
3. The board of directors of the Agency for Integration, Migration and Asylum (AIMA) has competence for the decisions provided for in this subsection, with the power to delegate.
