1. An application for family reunification may be refused in the following cases:
1 - O pedido de reagrupamento familiar pode ser indeferido nos seguintes casos:
a) Where the conditions for exercising the right to family reunification are not met;
a) Quando não estejam reunidas as condições de exercício do direito ao reagrupamento familiar;
b) Where the family member is subject to an entry and stay ban in national territory or is the subject of an alert in the Schengen Information System (SIS) for the purposes of return or of refusal of entry and stay;
b) Quando o membro da família esteja interdito de entrar e de permanecer em território nacional ou indicado no SIS para efeitos de regresso ou de recusa de entrada e de permanência;
c) Where the presence of the family member in national territory constitutes a threat to public policy, public security or public health.
c) Quando a presença do membro da família em território nacional constitua uma ameaça à ordem pública, à segurança pública ou à saúde pública.
2. Where the grant of an application for family reunification is precluded on grounds of:

a) Public policy or public security, account must be taken of the seriousness or type of offence against public policy or public security committed by the family member, or of the dangers that may arise from that person’s stay in national territory, as well as of the seriousness of developments in the public policy or public security situation in part or all of national territory;
a) Ordem pública ou segurança pública, devem ser tomadas em consideração a gravidade ou o tipo de ofensa à ordem pública ou à segurança pública cometida pelo familiar, ou os perigos que possam advir da permanência dessa pessoa em território nacional, bem como a gravidade da evolução da situação de ordem pública ou segurança pública em parte ou na totalidade do território nacional;
b) Public health, account must be taken of diseases defined in the applicable instruments of the World Health Organization or other infectious or contagious parasitic diseases that are the subject of protective measures in national territory, as well as of the response capacity of the health services.

3. Before a decision refusing an application for family reunification is taken, account shall be taken of the nature and solidity of the person’s family ties, the length of their residence in Portugal and the existence of family, cultural and social ties with the country of origin.
3 - Antes de ser proferida decisão de indeferimento de pedido de reagrupamento familiar, são tidos em consideração a natureza e a solidez dos laços familiares da pessoa, o seu tempo de residência em Portugal e a existência de laços familiares, culturais e sociais com o país de origem.
4. The refusal of an application submitted by a refugee may not be based solely on the lack of documents proving the family relationship.
4 - O indeferimento do pedido apresentado por refugiado não pode ter por fundamento único a falta de documentos comprovativos da relação familiar.
6. The refusal decision shall be notified to the sponsor with a statement of the grounds on which it is based and must state the right to bring a judicial challenge and the time limit for doing so.
6 - A decisão de indeferimento é notificada ao requerente com indicação dos seus fundamentos, dela devendo constar o direito de impugnação judicial e o respectivo prazo.
7. The decision refusing an application for family reunification may be the subject of a judicial challenge before the administrative courts, with non-suspensive effect.
7 - A decisão de indeferimento do pedido de reagrupamento familiar é susceptível de impugnação judicial, com efeito devolutivo, perante os tribunais administrativos.
8. Where the family members are already in national territory and the refusal decision is based exclusively on failure to meet the conditions laid down in paragraph 1(a), the judicial challenge has suspensive effect.
8 - Quando os membros da família já se encontrem em território nacional e a decisão de indeferimento se fundamente exclusivamente no incumprimento das condições estabelecidas na alínea a) do n.º 1 a impugnação judicial tem efeito suspensivo.
