1. Having weighed the principle of proportionality and the specific circumstances of the case, an application for long-term mobility may be refused:
1 - Ponderados o princípio da proporcionalidade e as circunstâncias específicas do caso, o pedido de mobilidade de longa duração pode ser indeferido:
a) In the situations provided for in Article 121-B(5);
a) Nas situações previstas no n.º 5 do artigo 121.º-B;
b) If the EU Blue Card issued by the other Member State has lapsed or been cancelled during the examination of the application.
b) Caso o 'cartão azul UE' emitido pelo outro Estado-Membro estiver caducado ou sido cancelado durante a análise do pedido.
2. Refusal decisions are notified in writing to the person concerned, or to their employer, within 30 days from the submission of the application, stating the grounds, the right to a judicial challenge and the time limit for it, and the obligation to leave national territory.
2 - As decisões de indeferimento são notificadas por escrito ao respetivo destinatário, ou ao seu empregador, no prazo de 30 dias a contar da apresentação do pedido, com indicação dos fundamentos, do direito de impugnação judicial e do respetivo prazo e da obrigação de saída de território nacional.
3. The time limit laid down in the preceding paragraph may exceptionally be extended by an equal period on the grounds of the complexity of the application.
3 - O prazo previsto no número anterior é prorrogável, excecionalmente, por igual período, com fundamento na complexidade do pedido.
4. Refusal decisions are also communicated by the Agency for Integration, Migration and Asylum (AIMA), in writing and preferably by electronic means, to the authorities of the Member State from which the EU Blue Card holder comes.
4 - As decisões de indeferimento são igualmente comunicadas, por escrito e preferencialmente por via eletrónica, pela AIMA, I. P., às autoridades do Estado-Membro do qual provém o titular do 'cartão azul UE'.
5. If the mobility application is refused, the Member State from which the EU Blue Card holder comes authorises the re-entry of the holder and their family members, without any formalities, even if the EU Blue Card issued has lapsed or been cancelled.
5 - No caso de indeferimento do pedido de mobilidade, o Estado-Membro do qual provém o titular do 'cartão azul UE' autoriza a sua reentrada e dos seus familiares, com dispensa de quaisquer formalidades, ainda que o 'cartão azul UE' emitido tenha caducado ou haja sido cancelado.
