1. The Agency for Integration, Migration and Asylum (AIMA) is responsible for requesting and obtaining from other entities the opinions, information and other elements necessary for compliance with this Law as regards the grant or renewal of residence permits.
1 - Compete à AIMA, I. P., solicitar e obter de outras entidades os pareceres, informações e demais elementos necessários para o cumprimento do disposto na presente lei em matéria de concessão ou de renovação de autorização de residência.
2. Without prejudice to the examination and verification of compliance with the other legal requirements laid down in this Chapter, when processing applications for a residence permit and for renewal of residence, AIMA shall:
2 - Sem prejuízo da análise e verificação do cumprimento dos demais pressupostos legais previstos no presente capítulo, no âmbito da instrução dos pedidos de autorização e de renovação de residência, compete à AIMA, I. P.:
a) Directly and immediately consult the Schengen Information System (SIS) databases; and
a) Proceder à consulta direta e imediata das bases de dados do SIS; e
b) Request, whenever it considers this necessary and justified, and obtain from the Borders and Foreigners Coordination Unit (UCFE) information with a view to verifying that there are no reasons of internal security or public policy, or of prevention of illegal immigration and related crime;
b) Solicitar, sempre que considere necessário e justificado, e obter da UCFE informação com vista à verificação da inexistência de razões de segurança interna ou de ordem pública, bem como de prevenção da imigração ilegal e da criminalidade conexa;
c) Directly and immediately consult the Visa Information System (VIS) database, ensuring the documentary and biometric interoperability of the data and documents collected or submitted at the consular stage of the application, within the scope of its functions.
c) Proceder à consulta direta e imediata da base de dados do Sistema de Informação sobre Vistos (VIS), assegurando a interoperabilidade documental e biométrica dos dados e documentos recolhidos ou apresentados na fase consular do pedido, no âmbito das suas atribuições.
3. The UCFE shall make the information referred to in point (b) of the preceding paragraph available to AIMA within 15 days.
3 - A UCFE disponibiliza à AIMA, I. P., a informação referida na alínea b) do número anterior, no prazo de 15 dias.
4. Failure by the UCFE to provide information to AIMA within the time limit laid down in the preceding paragraph is equivalent to the absence of reasons of internal security or public policy, or of prevention of illegal immigration and related crime, that preclude the grant or renewal of the residence permit.
4 - A ausência de prestação de informação pela UCFE à AIMA, I. P., no prazo previsto no número anterior, corresponde à inexistência de razões de segurança interna ou de ordem pública, de prevenção da imigração ilegal e da criminalidade conexa que não admitam a concessão ou renovação da autorização de residência.
5. Without prejudice to other decision time limits provided for in this Law, an application for the grant of a residence permit must be decided within 90 days; this time limit may be extended by 30 days in exceptional and duly justified circumstances, in particular owing to the complexity of the case, and the applicant shall be informed of the extension.
5 - Sem prejuízo de outros prazos de decisão previstos na presente lei, o pedido de concessão de autorização de residência deve ser decidido no prazo de 90 dias, o qual pode ser prorrogado por 30 dias, em circunstâncias excecionais e devidamente justificadas, designadamente em razão da complexidade do processo, sendo o requerente informado desta prorrogação.
6. An application for renewal of a residence permit must be decided within 60 days.
6 - O pedido de renovação de autorização de residência deve ser decidido no prazo de 60 dias.
8. A refusal decision shall be notified to the person concerned, stating the grounds as well as the right to bring a judicial challenge and the applicable time limit.
8 - A decisão de indeferimento é notificada ao interessado, com indicação dos fundamentos, bem como do direito de impugnação judicial e do respetivo prazo.
