1. The person concerned may request a duplicate residence card where the card is in poor condition, lost or mislaid, destroyed, stolen or taken by robbery, unless it is due for renewal under Article 78 or Article 121-E of Law No. 23/2007 of 4 July, as amended.
1 - Pode ser solicitada pelo interessado segunda via do título de residência em caso de mau estado de conservação, perda ou extravio, destruição, furto ou roubo, salvo se houver lugar à sua renovação, nos termos dos artigos 78.º ou 121.º-E da Lei n.º 23/2007, de 4 de julho, na sua redação atual.
2. The application shall be accompanied by a statement of the reasons for it and, in the case of loss, mislaying, destruction, theft or robbery, by information proving that the matter has been reported to the police.
2 - O pedido é instruído com a declaração dos motivos que o fundamentam e, no caso de perda, extravio, destruição, furto ou roubo, com informação comprovativa da respetiva participação à autoridade policial.
3. The application shall be accompanied, where necessary, by a facial image, as provided for applications for a residence permit, and, where the card is in poor condition, by the return of the original card.
3 - O pedido deve ser acompanhado, se necessário, de imagem facial, nos termos previstos para o pedido de autorização de residência, e, no caso de mau estado de conservação, deve ainda ser acompanhado da devolução do título inicial.
4. Where there is doubt as to the applicant’s identity or the legitimacy of the application, the issue of the duplicate may be granted or refused after the production of additional evidence, which may be obtained under Article 212(1) of Law No. 23/2007 of 4 July.
4 - Em caso de dúvida sobre a identidade do requerente ou sobre a legitimidade do pedido, a passagem da segunda via pode ser deferida ou recusada após prestação de prova complementar que pode ser obtida nos termos do n.º 1 do artigo 212.º da Lei n.º 23/2007, de 4 de Julho.
5. An application for a duplicate residence card on grounds of loss, mislaying, destruction, theft or robbery shall result in the entry of an alert on stolen, misappropriated or lost objects in the AIMA Integrated Information System (SII AIMA), which AIMA shall transmit to the Borders and Foreigners Coordination Unit (UCFE) for entry of the same alert in the UCFE Integrated Information System (SII UCFE) and in the Schengen Information System, and shall prevent the holder from using the original card if it is recovered, in which case the holder shall hand it in to AIMA.
5 - O pedido de segunda via de título de residência por perda, extravio, destruição, furto ou roubo determina a inserção de indicação de objeto furtado, desviado ou extraviado no SII AIMA, devendo este facto ser transmitido pela AIMA, I. P., à UCFE para inserção da mesma indicação no Sistema Integrado de Informação UCFE (SII UCFE) e no Sistema de Informação Schengen e impede que o seu titular o utilize se o recuperar, devendo neste caso proceder à sua entrega junto da AIMA, I. P.
