1. The acquirer of taxable goods or services who is a taxable person referred to in Article 2(1)(a), acting as such, and is not exempt, is jointly and severally liable with the supplier for payment of the tax where the mandatory invoice has not been issued or contains an incorrect indication of the name or address of the parties involved, the nature or quantity of the goods supplied or services provided, the price or the amount of tax due.

#

2. An acquirer or recipient who proves having paid all or part of the tax due to their supplier, duly identified, is released from the joint and several liability provided for in the preceding paragraph to the extent of the payment made, except in the case of bad faith.

#

3. Without prejudice to the joint and several liability for payment provided for in the preceding paragraphs, responsibility for issuing the invoices, for the accuracy of their content and for payment of the corresponding tax, in the cases provided for in Article 29(14), lies with the taxable person supplying the goods or services.

#

4. Notwithstanding the preceding paragraphs, where the tax results from a sham transaction or the price shown on the invoice is simulated, the acquirer of the goods or services who is a taxable person referred to in Article 2(1)(a), acting as such, even if exempt from tax, is jointly and severally liable for payment of the tax with the taxable person shown on the invoice as the supplier of the goods or services.

#

5. The joint and several liability provided for in the preceding paragraph applies even if the acquirer of the goods or services proves having paid all or part of the tax to the taxable person shown on the invoice as the supplier of the goods or services.
