1. In the case of supplies of goods or services carried out or declared with the intention of not paying the corresponding tax to the State, taxable persons covered by Article 2(1)(a) who have taken part or come to take part, at any stage of the economic chain, in transactions relating to those goods or services are also jointly and severally liable for payment of the tax, provided that they knew or should have known of those circumstances.

2. The preceding paragraph applies to the supplies of goods and services to be specified by order (despacho) of the Minister of Finance, where the transactions concerned relate to activities in which the practices described in paragraph 1 occur repeatedly.

3. For the purposes of this Article, a taxable person is presumed to know that the tax on the supplies of goods or services referred to in the preceding paragraph has not been or will not be paid in full to the State whenever the price payable by that person for the goods or services concerned is lower than the lowest price that it would be reasonable to pay under conditions of free competition or is lower than the price of those goods or services at earlier stages of the economic chain.

#

4. The presumption referred to in the preceding paragraph is rebutted if it is shown that the price charged at one of the stages of the economic chain was due to circumstances unrelated to an intention not to pay the tax.

What we checked in this article

The knowledge test (knew or should have known), the scope limited to supplies specified by order of the Minister of Finance, and the rebuttable price-based presumption are retained.
