1. A taxable person, wherever established, that makes available an electronic interface enabling third parties to offer goods for sale or to provide services, and that is not covered by Article 3(9) and (10) or Article 4(4), is jointly and severally liable with the supplier of the goods or the service provider for payment of the tax on transactions carried out through the interface, where it knows or should know that the supplier of the goods or the service provider does not pay the corresponding tax to the State.

2. Joint and several liability is triggered, in respect of the transactions carried out by the non-compliant supplier of the goods or service provider, from the date on which the taxable person making the electronic interface available is notified by the Tax and Customs Authority of the non-compliance detected.

3. The joint and several liability provided for in the preceding paragraphs does not apply where the taxable person, after being notified for that purpose by the Tax and Customs Authority and within 30 days, takes steps to ensure that the supplier of the goods or the service provider ceases to supply goods or services through the electronic interface or brings its VAT position in the national territory into compliance.

4. Without prejudice to the preceding paragraphs, the taxable person referred to in Article 51-A is jointly and severally liable for payment of the tax with the suppliers of the goods or the service providers in the event of failure to comply with the obligation laid down in paragraph 2 of that Article.
