1. Expenses or losses incurred or borne by a taxpayer having its registered office or place of effective management in Portuguese territory shall not be taken into account in determining taxable profit where the taxpayer is regarded as resident for tax purposes in another jurisdiction and those expenses are deductible under the laws of both jurisdictions, to the extent that, under the laws of the other jurisdiction, that double deduction may be offset against income that is not dual inclusion income.

2. Where the other jurisdiction referred to in the preceding paragraph is another Member State, that paragraph applies only where the taxpayer is regarded as resident for tax purposes in that other Member State under a double taxation convention in force.

What we checked in this article

The dual-residence condition, the deductibility in both jurisdictions, the offset-against-non-dual-inclusion-income test and the treaty-residence limitation for Member States are retained.
