1. The annual allocation to the provision referred to in Article 39(1)(d) corresponds to the amount obtained by dividing the estimated costs of repairing environmental damage at the sites used for operations, determined in accordance with point (a) of paragraph 3, by the projected number of years of operation of those sites.
1 - A dotação anual da provisão a que se refere a alínea d) do n.º 1 do artigo 39.º corresponde ao valor que resulta da divisão dos encargos estimados com a reparação de danos de caráter ambiental dos locais afetos à exploração, nos termos da alínea a) do n.º 3, pelo número de anos de exploração previsto em relação aos mesmos.
2. Where an irregular level of operation over time is expected, an annual amount different from that referred to in the preceding paragraph may be deducted; in that case, the taxpayer must notify the Tax and Customs Authority, by the end of the first tax period in which expenses for setting up or increasing the provision are recognised, of a plan for setting up the provision that takes account of that level of operation.
2 - Quando se preveja um nível de exploração irregular ao longo do tempo, pode deduzir-se um montante anual diferente do referido no número anterior, devendo, nesse caso, o sujeito passivo comunicar à Autoridade Tributária e Aduaneira um plano de constituição da provisão que tenha em conta aquele nível de exploração, até ao termo do 1.º período de tributação em que sejam reconhecidos gastos com a sua constituição ou reforço.
3. Setting up the provision is subject to compliance with the following conditions:
3 - A constituição da provisão fica subordinada à observância das seguintes condições:
a) Submission of a projected plan for the closure of operations, detailing the work to be carried out to repair the environmental damage and the estimate of the related costs, and stating the projected number of years of operation and any irregularity over time in the projected level of activity, subject to approval by the competent bodies;
a) Apresentação de um plano previsional de encerramento da exploração, com indicação detalhada dos trabalhos a realizar com a reparação dos danos de caráter ambiental e a estimativa dos encargos inerentes, e a referência ao número de anos de exploração previsto e eventual irregularidade ao longo do tempo do nível previsto de atividade, sujeito a aprovação pelos organismos competentes;
b) Setting up of a fund, represented by financial investments, which may be managed by the taxpayer itself, in an amount equivalent to the accumulated balance of the provision at the end of each tax period.
b) Constituição de um fundo, representado por investimentos financeiros, cuja gestão pode caber ao próprio sujeito passivo, de montante equivalente ao do saldo acumulado da provisão no final de cada período de tributação.
4. Whenever a review of the projected plan referred to in point (a) of the preceding paragraph results in a change in the estimated costs of the environmental rehabilitation of the sites used for operations, or the projected number of years of operation changes, the following procedure applies:
4 - Sempre que da revisão do plano previsional referido na alínea a) do número anterior resultar uma alteração da estimativa dos encargos inerentes à recuperação ambiental dos locais afetos à exploração, ou se verificar uma alteração no número de anos de exploração previsto, deve proceder-se do seguinte modo:
a) In the case of an increase in the estimated costs or a reduction in the number of years of operation, the annual allocation is thereafter calculated taking into account the total costs not yet provided for and the number of years of activity remaining for the operation, including the tax period of the review itself;
a) Tratando-se de acréscimo dos encargos estimados ou de redução do número de anos de exploração, passa a efetuar-se o cálculo da dotação anual considerando o total dos encargos ainda não provisionado e o número de anos de atividade que ainda restem à exploração, incluindo o do próprio período de tributação da revisão;
b) In the case of a decrease in the estimated costs or an increase in the number of years of operation, the excess part of the provision corresponding to the number of years already elapsed must be reversed in the tax period of the review.
b) Tratando-se de diminuição dos encargos estimados ou de aumento do número de anos de exploração, a parte da provisão em excesso correspondente ao número de anos já decorridos deve ser objeto de reposição no período de tributação da revisão.
5. The setting up of the fund referred to in point (b) of paragraph 3 is not required where a security bond must be provided in favour of the entity that approves the Environmental and Landscape Recovery Plan, in accordance with the legal regime governing the operation of the activity concerned.
5 - A constituição do fundo a que se refere a alínea b) do n.º 3 é dispensada quando seja exigida a prestação de caução a favor da entidade que aprova o Plano Ambiental e de Recuperação Paisagística, de acordo com o regime jurídico de exploração da respetiva atividade.
6. The provision must be applied to cover the costs for which it is intended by the end of the third tax period following the closure of operations; this period may be extended, up to a maximum of five tax periods, by prior notification to the Tax and Customs Authority, and the reasons justifying the extension must be included in the tax documentation file referred to in Article 130.
6 - A provisão deve ser aplicada na cobertura dos encargos a que se destina até ao fim do terceiro período de tributação seguinte ao do encerramento da exploração, podendo este período ser prorrogado, até ao máximo de cinco períodos de tributação, mediante comunicação prévia à Autoridade Tributária e Aduaneira, devendo as razões que o justificam integrar o processo de documentação fiscal a que se refere o artigo 130.º
7. The part of the provision not applied to the purposes for which it was set up is treated as income of the third tax period following the closure of operations or of the last tax period in which use of the provision is notified under the preceding paragraph.
7 - A parte da provisão não aplicada nos fins para que a provisão foi constituída é considerada como rendimento do terceiro período de tributação seguinte ao do encerramento da exploração ou do último período de tributação em que seja comunicada a utilização da provisão nos termos do número anterior.
The annual allocation formula, the notification of an allocation plan for irregular operation, the approved closure plan and matching fund conditions, the adjustment rules on plan revision, the security-bond exemption from the fund, the application deadline of three tax periods after closure (extendable to a maximum of five on prior notification), and the income inclusion of unapplied amounts are retained.
